These Terms of Service (“Terms”) govern access to and use of the TriRho website, coach dashboard, mobile applications, and related services (“Services”) provided by Tri-Rho Technologies LLC, doing business as TriRho (“TriRho,” “we,” “us,” or “our”).
By using the Services, you agree to these Terms. If you use the Services for an institution, club, or team, you represent that you are authorized to accept these Terms for that organization.
1. The Services
TriRho is a rowing team-management and performance platform. It helps authorized teams organize training, manage lineups, record performance information, review on-water sessions, and provide technique feedback.
TriRho is not a medical device, emergency-monitoring system, clinical diagnostic tool, or substitute for a coach’s, physician’s, or institution’s judgment. Availability, wellness, injury, and performance information must not be treated as medical advice or clearance to participate.
2. Institutional Agreements Control
If your institution has a signed pilot agreement, order form, data-processing addendum, or other written agreement with TriRho, that agreement controls to the extent it conflicts with these Terms.
The Services may be offered as a pilot or beta product. Features may change, contain defects, or experience planned or unplanned downtime.
3. Accounts and Access
You must provide accurate account information, keep your password confidential, and promptly notify us of suspected unauthorized access.
Access is role-based and limited to the team workspace to which you are assigned. You may not share accounts, bypass access controls, attempt to access another team’s data, or use the Services for an unauthorized purpose.
TriRho may suspend or remove access where reasonably necessary to protect users, the Services, or an institution.
4. Acceptable Use
You may not use the Services to:
• upload unlawful, threatening, discriminatory, harassing, sexually explicit, or otherwise inappropriate content;
• upload media captured in private areas, including locker rooms, bathrooms, or bedrooms;
• upload content without the rights, permissions, and consents needed to do so;
• violate another person’s privacy, intellectual-property rights, or applicable law;
• interfere with the Services, introduce malware, scrape data, or attempt to bypass security;
• use the Services for advertising, data brokerage, or unauthorized commercial purposes; or
• submit clinical records, diagnoses, or other medical documentation not requested by TriRho.
You remain responsible for content you upload. You grant TriRho a limited, non-exclusive right to host, process, display, and transmit that content solely to operate and improve the Services for your authorized team.
5. Content Moderation
TriRho may remove or restrict access to content that violates these Terms, applicable law, or a team’s authorized-use rules. Users may report suspected violations by contacting support@trirho.com.
6. Data and Intellectual Property
Institutions retain ownership of their team rosters, athlete records, performance metrics, and other institution-provided data. TriRho retains all rights in the Services, including the software, designs, database structures, analytics methods, branding, and documentation.
You may not copy, reverse engineer, distribute, sell, lease, or create competing products from the Services except where applicable law prohibits that restriction.
7. Fees
Any fees, pilot pricing, payment terms, renewals, and refunds are governed by the applicable order form or institutional agreement. TriRho does not offer consumer purchases through the mobile application.
8. Privacy
Our collection and use of information is described in the TriRho Privacy Policy at https://www.trirho.com/privacy.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIRHO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIRHO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
TRIRHO’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF $500 OR THE AMOUNT PAID TO TRIRHO BY THE APPLICABLE CUSTOMER FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
To the extent permitted by law, you will defend and indemnify TriRho from claims arising from your unlawful use of the Services, your uploaded content, or your violation of these Terms.
12. Termination and Deletion
You may stop using the Services at any time. Institutions may terminate a pilot according to their agreement with TriRho. Account and data deletion requests are handled as described in our Privacy Policy and at https://www.trirho.com/account-deletion.
13. Governing Law
These Terms are governed by the laws of the State of South Carolina, excluding conflict-of-law rules, except where applicable law requires otherwise.
14. Changes and Contact
We may update these Terms by posting an updated version with a new effective date. Continued use after the effective date means you accept the updated Terms.
